Granting an appeal submitted by Charles Mooty regarding the decision of the Zoning Board of Adjustment denying a variance (PLAN15502) to the minimum required front yard from 96.7 feet to 18 feet for lawful establishment of an existing outdoor pickleball court and to 10.3 feet for lawful establishment of existing retaining walls not retaining natural grade for the property located at 3501-3515 Zenith Ave S; and adopting Findings of Fact as prepared by the City Attorney's Office.

Directing the City Clerk and City Auditor to report to the Government Structure Subcommittee by May 9, 2023, on how to define, clarify, and strengthen the professional support provided by their respective offices to ensure effective support for the City Council’s official legislative, policymaking, and oversight functions.

Adopting findings that the proposed additional two positions (seven total positions) of Director IT Services meet the criteria in Section 20.1010 of the Minneapolis Code of Ordinances, City Council to Establish Positions; and approving the appointed positions, evaluated at 638 total points, and allocated to Grade 14.

Accepting the low bid Affinitech, Inc., submitted on Event 2136, in the amount of $ 839,835, to provide all materials, labor, equipment and incidentals necessary for the Minneapolis Convention Center Video Surveillance System Upgrade project, and authorizing a contract for the project, all in accordance with City specifications.

Accepting the low bid of Eureka Construction, Inc. submitted for Event 2211, in the amount of $5,798,164.32, to provide all materials, labor, equipment and incidentals necessary for the Upper Harbor Terminal – Dowling Ave North Construction Project, and authorizing a contract for the project, all in accordance with City specifications.

Accepting the low bid of Meyer Contracting, Inc, for Event 2067, in the amount of $9,288,604.58,to provide all materials, labor, equipment and incidentals necessary for the Signals, Storm Sewer & Curb Ramp Improvements project, and authorizing a contract for the project, all in accordance with City specifications.

Authorizing an increase to contract C-39200 with OneNeck IT Solutions LLC, in the amount of $5,730,000 for a new not to exceed total of $46,503,000, and an extension for up to an additional two years through Feb 28, 2025, for providing outsourced managed IT services.

Authorizing an increase to Contract C-40242 with DataNet Systems Corporation, in the amount of $363,142 for a new not to exceed total of $2,338,142, and a three-year extension through Sep 30, 2028, to provide hosting and professional services for the Legislative Information Management System (LIMS) and Constituent Relationship Management (CRM) applications.

Authorizing an increase to contract COM0001520 with Formations Studio, LLC, in the amount of $19,511 for a total amount not to exceed $839,703, for the repairs to the ceiling above the Suspended Lobby Sculpture in the new Public Service Building.

Authorizing an increase to COM0002552 with Hennepin Healthcare System, Inc., in the amount of $79,000 for a total amount not to exceed $250,000, to support teen parent employment and training services in the healthcare sector.

Authorizing an increase to master contract COM0003171 with Tree Trust, in the amount of $1,000,000 for a new not to exceed amount of $1,500,000, for environmental tree services through Dec 31, 2025.

Authorizing an increase to Master Contract COM0003173 with The Link, in the amount of $1,200,000 for a new total amount not to exceed of $2,200,000, for the period 2023- 2025, for the Juvenile Supervision Center. 

Approving the settlement of the lawsuit of Hillary Richard v. City of Minneapolis and Oscar Macias by payment of $45,000 to Plaintiff and Plaintiff’s counsel in the form of two checks: $29,340.17 payable to Hillary Richard and $15,659.83 payable to Attorney Jordan S. Kushner, and authorizing the City Attorney's Office to execute any documents necessary to effectuate the settlement.

Approving the settlement of the Public Employee's Retirement Association continuing healthcare benefit appeal of Minneapolis by payment of $50,000 to Daniel Payne through attorneys at Meuser, Yackley and Rowland, and dismissal of the City's appeal in exchange for Mr. Payne's permanent waiver of his right to claim continuing health benefits paid for by the City of Minneapolis; and authorizing the City Attorney's Office to execute all documents necessary to effectuate settlement.

Considering the Mayor's nomination of Damon Chaplin to the appointed position of Commissioner of Health for a term ending January 2026.

Approving the list of routes and dates for 2023 Minneapolis Open Streets. 

Passage of Resolution affirming that the City will enter into a sub-grant agreement with the Division of Homeland Security for the Federal Emergency Management  Agency's (FEMA) Building Resilient Infrastructure and Communities (BRIC) program.

Approving a legislative directive that would provide a high-level analysis of potential City-led sidewalk snow and ice removal programs that could be fully implemented by winter of 2027.

Chavez and Payne give notice of intent to introduce at the next regular meeting of the City Council the subject matter of an ordinance amending Title 12, Chapter 244 of the Minneapolis Code of Ordinances relating to Housing: Maintenance Code, amending provisions related to the prohibition of skateboard ramps or structures.

Pursuant to notice, motion by Osman to introduce the subject matter of an ordinance amending Title 13, Chapter 281 of the Minneapolis Code of Ordinances relating to Licenses and Business Regulations: Tobacco Dealers, for first reading and referral to the Business, Inspections, Housing & Zoning Committee, amending regulations to provide a limited license spacing exemption for qualifying commercial malls.

Pursuant to notice, motion by Chughtai, Ellison, and Osman to introduce the subject matter of an ordinance amending Title 15, Chapter 389 of the Minneapolis Code of Ordinances relating to Offenses--Miscellaneous: Noise, for first reading and referral to the Public Health & Safety Committee, amending the noise violation exemption related to sounds associated with religious worship.

Directing the City Clerk to coordinate all arrangements for a joint meeting with the Charter Commission’s Government Structure Work Group.

Rescinding Council Action 2023A-0072 and terminating the contract with Rachel Contracting, LLC, for the Hiawatha Public Works – Phase II Demolition Project, and authorizing staff to execute any and all documents necessary to effectuate the termination of that contract.

Approving a legislative directive requesting staff to identify all prior actions associated with the definition, creation, and authorization of the Hiawatha Maintenance Facility Campus Expansion Project and to forward those to the City Council at its regular meeting scheduled for Mar 9, 2023, for its consideration in terminating that project in its entirety.
