Passage of Resolution amending the 2023 General Appropriation Resolution by revising the Financial Management Policies.

Denying an appeal submitted by Northside Residents Redevelopment Council regarding the following decisions of the City Planning Commission (PLAN15511) for a new four-story, multiple family dwelling located at 1254 Russell Ave N:

1. Approving the variance to reduce the minimum front yard setback along Russell Ave N from 28.1 feet to four and 1/2 feet.
2. Approving the variance to reduce the minimum corner side yard setback along Plymouth Ave N from eight feet to zero feet.
3. Approving the site plan review application to allow for a new 25-unit residential building.

Denying an appeal submitted by Northside Residents Redevelopment Council regarding the following decisions of the City Planning Commission (PLAN15510) for a new five-story residential building located at 2309 Plymouth Ave N:

1. Approving the variance to reduce the minimum front yard along Queen Ave N from 35 feet to three feet.
2. Approving the variance to reduce the minimum corner side yard setback along Plymouth Ave N from 10 feet to one foot.
3. Approving the site plan review for a new 38-unit residential building. 

Denying an appeal submitted by Stephanie Hawkinson regarding the decision of the City Planning Commission approving the site plan review application (PLAN15521) to allow a four-story,12,000 square foot addition to an existing building for the property located at 4300 and 4312 Upton Ave S.

Denying an appeal submitted by Ian Harrison regarding the decision of the City Planning Commission approving the site plan review application (PLAN15521) to allow a four-story, 12,000 square foot addition to an existing building for the property located at 4300 and 4312 Upton Ave S.

Adopting the Rental License Conditions and Stipulated Agreement negotiated between the City of Minneapolis and the licensee for the Rental Dwelling Licenses held by FYR SFR Borrower LLC for all 210 addresses, allowing the licensee to retain the Rental Dwelling Licenses for said properties, subject to adherence with the conditions contained therein.

Passage of Resolution approving the Hennepin County Housing and Redevelopment Authority (HCHRA) to provide financial assistance to the following projects: 550 West Lake (550 Lake St W), Shelby Commons (188 1/2 Glenwood Ave), Whittier Community Housing (2609 Blaisdell Ave S), 16-plex Rehab (1814 Glenwood Ave), North Haven (2216 and 2220 Clinton Ave S), Passage Community Housing (17 24th St E), and NACC-H (1213 Franklin Ave).

Authorizing the City to enter into an Access Agreement with Northern Tier Retail, LLC for 3744 Chicago Ave.

Passage of Resolution supporting Kannegiesser ETECH’s application for financial incentives from the Minnesota Department of Employment and Economic Development’s Job Creation Fund.

Passage of Resolution approving an amendment to the City's comprehensive plan to amend the built form guidance from Corridor 6 to Interior 3 for the properties located at 625, 629, 641, 643, 649, 653, 655, 659, 705, 711, 715, 719, 723, 727, 733, 737, 741, 747, 751 Van Buren St NE and 901 Summer St NE.

Passage of Resolution approving an amendment to the City's comprehensive plan to amend the built form guidance from Corridor 6 to Transit 10 for the properties located at 800 28th St E; 2701 Elliot Ave; 2742 10th Ave S; 920 28th St E; 924 28th St E; 916 28th St E; and 2753 Chicago Ave.

Authorizing the acquisition of a utility easement from Xcel Energy for $60,000 for the construction of the Border Avenue Extension project.

Authorizing collective bargaining agreement with the Minnesota Teamsters Convention Center Custodian Unit, for the periods Jan 1, 2022, through Dec 31, 2024, consistent with the terms of the Executive Summary; and authorizing the Labor Relations Director to implement the terms and conditions of the agreement.

Accepting the sole bid of AAMS General Contractor LLC, submitted on Event 2232, in the amount of $174,122, to furnish and deliver Epoxy Grade 60 Reinforcing Bars and Miscellaneous Materials, and authorizing a contract for the project, all in accordance with City specifications.

Accepting the low bid of Spriggs Plumbing and Heating, Inc. submitted on Event 2246, in the amount of $109,000, to provide all materials, labor, equipment and incidentals necessary for the Target Center Sanitary Piping Repairs Project, and authorizing a contract for the project, all in accordance with City specifications.

Accepting the low bid of Concrete Idea, Inc., submitted on Event 2239, in the amount of $1,725,022, to provide all materials, labor, equipment and incidentals necessary for the Folwell and 46th Ave S ADA Pedestrian Ramp Program, during the 2023 construction season, all in accordance with City specifications.

Accepting the low bid of Meisinger Construction Co., Inc. submitted on Event 2301, in the amount of $1,454,000, to provide all materials, labor, equipment and incidentals necessary for the Minneapolis Convention Center Exhibit Halls A, B, C, D Door Replacement, and authorizing a contract for the project, all in accordance with City specifications.

Accepting the low bid of Paragon Restoration II, Inc. submitted on Event 2262 in the amount of $195,000, to provide all materials, labor, equipment and incidentals necessary for the Target Center Floor Repair and Coating - Phase 2 Project, and authorizing a contract for the project, all in accordance with City specifications.

Accepting the sixth low bid of Chefs Depot, Inc. submitted on Event 2187, in the amount of $164,695.64, to furnish and deliver Food Service Equipment - Grab and Go Stands for Target Center, and authorizing a contract for the project, all in accordance with City specifications. 

Accepting the low bid of Concrete Idea, Inc., submitted on Event 2183, in the amount of $4,208,650, to provide all materials, labor, equipment and incidentals necessary for the construction of Concrete Sidewalks, Curb and Gutter, Alleys and Driveway Approaches, and authorizing a one-year contract for the 2023 construction season, all in accordance with City specifications.

Accepting the low bid of Premier Electrical Corporation, submitted on Event 2209, in the amount of $950,000, to provide all materials, labor, equipment and incidentals necessary for Minneapolis Convention Center As-Needed Electrical Services Project, and authorizing a one-year contract, beginning Jan 1, 2023, with the option to extend for four additional twelve-month periods, all in accordance with City specifications.

Authorizing a contract with Affordable Housing Connections, in the amount not to exceed $411,000, with costs billed in accordance with the attached fee schedule, for a three-year term with the option to extend for two one-year terms including an increase by $130,000 in year four and by $99,000 in year five, to provide affordable Housing Trust Fund (AHTF) HOME monitoring consulting services.

Authorizing a contract with Cale America (dba Flowbird), in the amount of $5,000,000, for a three-year period, with the option to extend for an additional two-year term, for supplying a mobile application that can be used by customers for making payments in metered parking areas.

Authorizing an increase to Contract No. COM0005658 with ASC Acquisition Company, LLC., in the amount of $19,445 for a total amount not to exceed $664,273, due to unforeseen conditions on the Minneapolis Parking Ramp Sign Replacement Project, all in accordance with City specifications. 

Authorizing an increase to Contract C-24593 with Bentley Systems, Inc., in the amount of $740,984 for a new total amount not to exceed $3,666,170, and an extension through Dec 31, 2025, for the licenses and maintenance and support of the Bentley suite of software products used by the Department of Public Works for project design and storage.

Authorizing an increase to contract #COM0004956 with Change Equals Opportunity (CEO), in the amount of $50,000 for a total amount not to exceed $225,000, and an extension through Mar 31, 2023, to ensure continuity of group violence intervention services.

Authorizing an increase to contract COM0005281 with Michels Corporation, in the amount of $339,545.07 for a total amount not to exceed $3,966,544.57, for additional quantities and extra material needed for the cleaning and lining of water mains.

Authorizing an increase to Contract No. C-43247 with MA Mortenson, in the amount of $75,442 for a total amount not to exceed $20,745,519, for Construction Manager (as an Advisor) services to include reimbursement of costs associated with increased scopes of ancillary work and an extended project schedule for the Public Service Building.

Authorizing an increase to Contract No. COM0006157 with Meisinger Construction Co., Inc., in the amount of $5,849 for a total amount not to exceed $705,749, for additional work required to complete the Minneapolis Convention Center Corridor Ceiling Replacement Project.

Authorizing an increase to Contract No. COM0005021 with Pioneer Power, Inc., in the amount of $10,864 for a total amount not to exceed $488,864, for additional work required to complete the Cooling Coil Replacement Project.

Approving the settlement of the lawsuit Kacey White, Charles Stotts, d/b/a Town Talk Diner v. City of Minneapolis, Mayor Jacob Frey, by payment of $5,000 to Plaintiff Kacey White by a check made out to Kacey White, and $5,000 to Plaintiff Charles Stotts by a check made out to Charles Stotts, and authorizing the City Attorney's Office to execute any documents necessary to effectuate the settlement.

Authorizing collective bargaining agreement with the Building Trades Inspectors Unit, for the periods Jan 1, 2022, through Dec 31, 2024, consistent with the terms of the Executive Summary; and authorizing the Labor Relations Director to implement the terms and conditions of the agreement.

Authorizing the submittal of a grant application to the Minnesota Division of Homeland Security and Emergency Management, in an amount up to $34,690 from Jan 1, 2022, through Jun 30, 2023, to support Emergency Management's mission areas of prevention, preparation, mitigation, response, and recovery.

Authorizing the submittal of a grant application to the Minnesota Division of Homeland Security and Emergency Management, in the amount $829,500, over an 18 month period to support the Emergency Management Department's mission areas of prevention, preparation, mitigation, response, and recovery.

Passage of Resolution approving appropriation of funds to the Health Department.

Authorizing an amendment to contract C-43540 with the Minnesota Department of Transportation (MnDOT) to transfer responsibility for signal timing maintenance for the traffic signal at Industrial Blvd and I-35W from MnDOT to the City of Minneapolis.

Authorizing the submittal of a grant application to the United States Department of Transportation, in the amount of $1,975,000, for a SMART (Strengthening Mobility and Revolutionizing Transportation) grant titled "An Open Data Approach to Curbside Management" to build digital tools and a common data language to communicate demand and availability of curbside parking.

Authorizing the submittal of a grant application to the United States Environmental Protection Agency, seeking up to $4,000,000 in SWIFR grant funding, to return the North Transfer Station to an operating transfer facility.

Authorizing the submittal of a grant application to the Federal Emergency Management Agency's (FEMA) Building Resilient Infrastructure and Communities (BRIC) Program, in the amount of $1,087,800, for a project that will increase emergency generator fuel storage capacity at Water Works Pump Station 5.

Wonsley, Chavez, and Osman give notice of intent to introduce at the next regular meeting of the City Council the subject matter of an ordinance amending Title 13 of the Minneapolis Code of Ordinances relating to Licenses and Business Regulations, amending provisions to expand worker protections:

1. Chapter 341 Taxicabs.
2. Chapter 343 Transportation Network Companies.

Passage of Resolution recognizing January 2023 as Stalking Awareness Month in the City of Minneapolis.

Passage of Resolution amending Resolution 2022R-009 entitled "Approving appointments of Council Members to various Boards and Commissions," passed January 27, 2022, by amending the appointment to the Planning Commission.

Approving the settlement of all claims involving Defendant Leo A. Daly Company, and Third-Party Defendants Golden Industrial Refrigeration, LLC, Generator Studio, LLC, and Stantec Consulting Services Inc., asserted in City of Minneapolis v. Leo A. Daly Company and Ice Builders v. Golden Industrial Refrigeration, et al, Hennepin County District Court File 27-cv-21-14450, pursuant to the terms of the settlement agreement and release entered into by the parties, for the total sum of $800,900 to be paid to the City of Minneapolis; and authorizing the City Attorney’s Office to execute and file any documents necessary to effectuate this settlement.

1. Approving the settlement of all claims against the City of Minneapolis and any of its named or unnamed employees, including claims for attorneys’ fees and costs, asserted by Chukwumuanya Onyiuke in the matter of Chukwumuanya Onyiuke v. City of Minneapolis, MDHR Case No. 73267, be settled in the amount of $10,500, payable in the following manner: 1) One check in the amount of $8,075 payable to Chukwumuanya Onyiuke, for which the City will issue a Form 1099-MISC; and 2) One check in the amount of $2,425 payable to Chukwumuanya Onyiuke’s attorney, Smith Law, for which the City will issue a Form 1099-MISC to each of Chuwumuanya Onyiuke and his attorney.
2. Agreeing to a partial release of claims against Chukwumuanya Onyiuke in exchange for payment by Chukumuanya Onyiuke in the amount of $1,000.
3. Authorizing the City Attorney’s Office to execute all documents necessary to effectuate this settlement.
